Del Monte loses: Court dismisses Company Application to be Enjoined in Land lease Case

The Environment and Land Court in Murang'a on Thursday dismissed Delmonte’s application seeking to be enjoined in a land lease renewal case.

Delmonte had sought to be enjoined in a case where two petitioners Ephantus Githae and James Mwangi, were seeking orders to have the County advertise the land under public Procurement and Disposal Act.

In January, the petitioners filed a petition requesting the expansive pineapple farm to be sold to the highest bidder and that they be involved in the decision making process through public participation.
The petitioners protested that if Del Monte was enjoined, it would jeopardize the whole justice and procurement process.

Justice Grace Kemei, stated that Delmonte did not demonstrate to the court how its interests over the leaseholds in question would be affected if it is not enjoined in the petition.

“The applicant has not demonstrated the prejudice it stands to suffer if the application is disallowed. …the application is without merit and it is dismissed with costs to the applicant,” She said.
